Annie Selke, LLC and our affiliates and subsidiaries (collectively “Annie Selke”) are committed to respecting the privacy rights of our customers. This Privacy Policy summarizes what information we collect and how we use it. 

Throughout this Privacy Policy, we may refer to Annie Selke as “Annie Selke,” “we,” “us” or “our.” When we say “Websites” we mean any of our websites or applications which link to this Privacy Policy and any other microsites, social media pages, mobile versions of those websites, or Short Messsage Service (“SMS or text message”) channels. “Social Media Pages” are the official social media pages we operate on Facebook, Pinterest, Instagram, TikTok, LinkedIn, and other social media platforms. This Privacy Policy applies to information we collect through our Websites, Social Media Pages and our communications with you.

We may collect the information described above directly from you, from third parties we partner with, or through cookies or other automated means. These categories include:

  • You: We collect information directly from you, whenever you: make a purchase; visit our Websites; contact us with questions or comments; upload content; create an account; sign up for communications; respond to a survey; write a review; or use or like our Social Media Pages.

We receive aggregate information from these third parties to understand our advertising effectiveness. The Website uses cookies to help us keep track of items that you put into your shopping cart including when you have abandoned your cart and this information is used to determine when to send you cart reminder messages via text messages.

  • Security: Protecting Annie Selke and our customers from fraud, security threats, and other illegal or harmful activity.
  • De-identified data: Creating de-identified and aggregated information, including but not limited to, analyzing general market trends.
  • Legal Obligations: Complying with legal and regulatory requirements and responding to requests from courts or other government bodies.

How We Share Information with Service Providers and Third Parties and for What Purposes

We may share your information in the following ways:

  • Affiliates and Subsidiaries: Annie Selke may share your information with our affiliates and subsidiaries in order to provide services to you.
  • Service Providers: We partner with third parties to assist with many aspects of our business, including fulfilling orders, advertising, analyzing your interests and activity on our Websites and Social Media Pages, and helping us communicate with customers. These third parties may provide services related to any of the purposes described in How We Use Collected Information, and we may share with them any types of information described in Information We Collect. We may also receive information collected by these third parties and combine it with the information we have collected. Your information may also be collected and processed by third parties, such as the payment providers you select, who will process your information independently in accordance with their own privacy notices.
  • Marketing Providers: We partner with third parties to assist with the advertising and marketing of our business. We may share with them the types of information described in How We Use Collected Information
  • Legal Compliance: We will disclose information about you, including to government bodies or law enforcement agencies, when we believe it to be necessary for compliance with the law or to protect our Website users, our Website, or the public.
  • Parties to a Business Transaction: If Annie Selke were ever merged with or acquired by another company, or it acquires another company, or is involved in a corporate reorganization or other change in corporate control, your information could be shared with that business entity.

Notwithstanding the foregoing, we will not share your opt-in to an Annie Selke SMS campaign with any third party for purposes unrelated to providing you with the services of that campaign. We may share your personal data with third parties that help us provide our messaging services, including but not limited to platform vendors , phone companies, and any other vendors who assist us in the delivery or receipt of text messages.

Your Privacy Choices

You can control the information we collect and use in the following ways:

  • Location Information: You can disable location-based services on your mobile device or web browser by adjusting the settings on your device or browser. This will prevent our Websites from accessing your location information. Note that some services may not be available if you disable location-based services.
  • Emails: You can unsubscribe from marketing emails by clicking the unsubscribe link in the footer of such email.

  • Online Accounts: You can keep your contact information and payment methods accurate and up to date by logging into your account on our Websites. If you wish to cancel your account, email us at privacy@annieselke.com.
  • Social Media: This privacy policy does not cover the privacy and security practices of social media platforms on which we have Social Media Pages. Please review the terms, policies, and settings of those social media platforms if you have questions about how they collect and use your data.
  • Online Advertising: For information about opting out of third party advertising, visit: NAI Opt-Out and DAA Opt-Out (you will leave this Website for a separately managed online site where you can specify your preference under those programs). You can also click on the icon that may appear on some of our advertising served through these technologies. We may use more than one third party company for placing this advertising, which would require you to opt out of each company.
  • Cookies and Similar Technologies: You may block cookies and similar technologies in your browser or device settings, as and if permitted by such device.
  • Google Analytics: You can opt out of Google Analytics across all websites you use. To do so, visit this website.

Texting Policy

If you elect to receive marketing and support text messages from us, either via our website or by sending a text message indicating your consent, you are providing your prior express written consent to receive recurring marketing, promotional, and support text messages from us (each, a “Text Message”) sent through an automatic telephone dialing system. Message frequency varies. This service is optional, and your consent is not a condition for purchase. You can opt out of receiving any further Text Messages from this program at any time by replying “STOP” to any Text Message you receive from us. For help, reply “HELP” to any Text Message you receive from us or email info@annieselke.com. Your mobile providers’ message and data rates may apply to our confirmation Text Message and to all subsequent Text Messages according to your individual rate plan provided by your wireless carrier. Please consult your mobile service carrier’s pricing plan to determine the charges for browsing data and sending and receiving Text Messages. Under no circumstances will we or our affiliates be responsible for any text messaging or wireless charges incurred by you or by a person that has access to your wireless device or telephone number. If your carrier does not permit Text Messages, you may not receive our Text Messages. Neither we nor the wireless carriers will be liable for any delays in the receipt of, or failure to deliver, any Text Messages, as delivery is subject to effective transmission from your network operator. Text Message services are provided on an “AS IS” basis. Data obtained from you in connection with any Text Message services may include your cell phone number, your provider’s name and the date, time and content of your text messages. We may use this information in accordance with this Privacy Policy to contact you and to provide the services you request from us.

Children’s Privacy

Our Website is not intended for children under 16. No one under 16 should share any personal data with us through the Website. We do not knowingly collect any personal data from children under 16 on our Website. To request deletion of personal data relating to a child under 16, please email privacy@annieselke.com.

Security

Annie Selke cares about the security of your information. We have implemented a variety of security measures to maintain the safety of your personal information. While we take these measures, no security measures are perfect or impenetrable.

Supported Web Browsers and Do Not Track Signals

We may not be able to receive or honor web browser “Do Not Track” signals and our Websites may continue to collect information in the manner described within this Privacy Policy. 

Updates

We reserve the right to modify, alter, or otherwise update this Privacy Policy at any time, so we encourage you to review this policy from time to time. Changes to this Privacy Policy are effective at the time they are posted and your continued use of our sites after posting will constitute acceptance of, and agreement to be bound by, those changes. Certain U.S. states afford their residents rights with respect to their Personal Data. The rights described herein are subject to exemptions under applicable law. We will provide your Personal Data to you in writing in a readily usable format. If you choose to submit your request via email, you must include “Privacy Rights Request” in the subject line and clearly provide us with the following information: what type of request you are making, your full name, email address, and shipping address. You may only make one request per email. 

Annie Selke is required to provide you with access to your Personal Data or delete your Personal Data only in response to verifiable consumer requests. We will compare the information you provide by telephone or via email with any information we may have in our possession in order to verify your request. We may also contact you to request additional information in relation to your request. The information you provide must match the information we have in our possession. This measure is in place to help ensure that Personal Data is not disclosed to any person who does not have the right to receive it. The information collected through this process will be used for verification purposes only.

Authorized Agent

Please note that you may authorize an agent to exercise any of these rights on your behalf by contacting us by email at privacy@annieselke.com. If you use an agent, we will take measures to verify your agent’s authorization similar to the verification described above. Notice of Financial Incentive

We also sometimes offer exclusive price discounts, rewards, offers, deals, coupons, or other perks for those recipients of our mailing lists who were presented with a financial incentive to sign up and provide us with their email address or mobile phone number. Under California law, participating in any of our Programs is considered a financial incentive provided in exchange for the collection and retention of personal information. Through our loyalty or rewards programs, consumers may provide us with any or all of the categories of information in the Information We Collect section above. Participation in these programs is optional and consumers may opt out at any time. In addition to this disclosure, each program contains terms specific to that promotion. Your participation in any of these programs will be interpreted as affirmative consent to the terms of that particular program.

We offer these Programs to, among other things, enhance our relationships with our customers. The value to our business, in the aggregate, of customers’ personal information depends on specific facts, such as whether and to what extent they take advantage of any offerings. We do not calculate the value of customers’ information for our accounting statements. To the extent we would, however, such valuation could be directly or reasonably related to the cost associated with acquiring or developing such information. 

Deletion Rights

You may request that we delete your Personal Data that we have collected directly from you. Under applicable law, we may decline to delete your Personal Data under certain circumstances, for example, if we need the Personal Data to complete transactions or provide services you have requested or that are reasonably anticipated, for security purposes, for internal business purposes (including maintaining business records), to comply with law, or to exercise or defend legal claims. Note also that we are not required to delete your Personal Data that we did not collect directly from you.
